Subject: Implementation of RTE Amendment Rules in Kendriya Vidyalayas-reg.
Madam/Sir,
As intimated by the Ministry of Education vide letter dated 15.01.2025, the RTE Amendment Act, 2019, which revised the ‘No-Detention’ provision under Sections 16 and 38 of the RTE Act, 2009, has been in effect since 1st March 2019. Accordingly, the Central Government, as the competent authority for Kendriya Vidyalayas, has amended the RTE Rules, 2010, to incorporate these changes. The amendments have been notified in the Gazette of India (G.S.R. 777(E), dated 16th December 2024, and published on 21st December 2024. In this regard for effective implementation of the RTE Amendment Rules, it is requested to direct the Principals of all KVs under the Region to implement the following guidelines for in Classes V and VIII with effect from 2025-26 onwards.
- The amended provisions concerning Class V and VIII will come into effect from the Academic Session 2025-26.
- Informing Principals and teachers: The Principals and teachers should be thoroughly sensitised on the provision and the monitoring of academic progress of the students.
- Conduct of Parent-Teacher Meetings (PTMs): All schools must conduct first PTM in April 2025 and inform all stakeholders- students and parents/ guardians about the contents of the Gazette notification to ensure awareness of the changes. Additionally, KVs may issue a separate communication to parents in writing detailing these provisions. This provision needs to be highlighted in subsequent PTMs also.
- After the Annual Examinations, students who do not meet the promotion criteria, as notified from time to time, shall receive additional instructions and be given an opportunity for re examination within two months of the result declaration especially before Summer Vacation.
- During this period, the concerned subject teacher must provide necessary guidance to the student and parents, offering targeted support to address identified learning gaps and improve academic performance.
- Schools must enhance communication with parents regarding their child’s academic progress. Teachers should actively engage with parents to discuss learning gaps and the remedial measures being implemented.
- The Principal must maintain a record of students held back and personally monitor the specialized support provided to them, ensuring regular follow-ups to track progress.
- The examination and re-examination will follow a competency-based approach, emphasizing holistic development over rote memorization and procedural skills, thereby fostering deeper understanding and overall growth.
- If a student fails to meet the promotion criteria in the re-examination, he/ she shall be retained in Class V or VIII, as applicable.
- No child shall be expelled from the school until the completion of elementary education, ensuring that every student has the opportunity to complete their schooling.
Therefore,it is requested to direct to ensure the effective implementation of these provisions in all Kendriya Vidyalayas under the jurisdiction, in accordance with the enclosed notification.
